Clark County waterfront dispute winds down

Two years after a proposed 65-acre development on the east Clark County waterfront collapsed, the battle between the project’s would- be partners is wrapping up in court. An arbitrator’s judgment against developer RiverWalk on the Columbia LLC was presented in Clark County Superior Court Friday.
Superior Court Judge John Nichols is scheduled to address the judgment Dec. 10.
The RiverWalk project was originally envisioned to include a marina, hotel, offices, restaurants retail, recreational and residential developments along the Washougal, Wash., waterfront. When a two-year deal between the Port of Camas-Washougal and RiverWalk ended in 2007 without the sides in agreement, the port pulled out of the project.
RiverWalk then sued the port for $19.5 million and the case went to arbitration. In May, arbitrator JAMS, originally Judicial Arbitration and Mediation Services, sided with the port.
“The interim decision found for the port essentially on every point,” said port spokesman Jack Hardy.
On July 28, JAMS ruled that the port was entitled to roughly $608,000 in legal costs stemming from the case. The port then filed a motion in Superior Court to confirm that award.
RiverWalk’s claim faulted the port’s efforts to reach a deal on the development, citing a three-month delay gap between receiving a draft development agreement and responding to it. JAMS ruled that this time period was reasonable for port lawyers to review the draft agreement.
According to the arbitrator’s findings, RiverWalk proposed “an obviously inadequate (master development agreement) and then tried to shift the blame for ‘no response’ onto the Port.”
RiverWalk officials knew more than their port counterparts about the troubles of moving the development forward. One key piece was the failure to buy the Hambleton Lumber mill adjacent to the port property and essential to the development.
“It was undisputed that the Hambleton family would not sell,” the arbitrator’s report reads. “Riverwalk never really dealt with the blow to their visionary plan by RiverWalk’s inability to purchase the Hambleton property, and never came up with alternatives to their ‘vision.’”
Despite prevailing in arbitration, the port didn’t come through the process unscathed. The state auditor dinged port officials in March for backroom dealing with RiverWalk. “The public was excluded from all discussion about the proposed development until after the agreement with the developer was signed,” the auditor’s report read.

Missing girl's mother looks back on 'remarkable year'

HAYWARD — Standing in front of a tree yellow with ribbons honoring her kidnapped daughter, Sharon Murch told a crowd assembled in a Mission Boulevard parking lot that 2009 has been a “remarkable year.”
“I don’t believe in coincidences,” Murch said Thursday, the 21st anniversary of Michaela Garecht’s abduction. “All this must be for some purpose.”
“All this” started over the summer. Murch started blogging to supplement the Web site dedicated to finding her daughter, who was snatched in 1988 at age 9 from the grocery store lot.
Then in late August, Jaycee Dugard was found, 18 years after being abducted in South Lake Tahoe at age 11. Not only did she have opportunities to leave the home near Antioch where she lived with Phillip Garrido, the man accused of abducting her, she tried to thwart being found during the questioning that ultimately uncovered her identity, according to authorities.
“That totally revolutionized everything I had been thinking,” Murch said. “As more and more information came out, I started to understand how she might be somewhere and have the ability to free herself, but not want to. That’s probably the best of all possible situations — that she’s with someone she cares enough about to protect, that she doesn’t want to reveal herself.”
Hayward police noticed similarities between the Jaycee and Michaela cases, and in September they conducted what is thought to be the most extensive search in the history of the department, camping out on the Garrido property for a week to search for evidence.
While nothing linking Michaela to the scene was found, police said they have not ruled out Garrido or his wife, Nancy, as suspects.
Murch lauded police for their efforts Thursday, saying they have demonstrated intelligence and compassion throughout the investigation, showing they know that “behind Michaela, there is a family who misses her very much.”
September’s search threw Michaela’s case — and Murch — back into the public’s consciousness.
Murch said she gets e-mail messages every day from all over the world — some simply to encourage her, others offering unsolicited advice for investigators, and some frustrating messages that could be an important tip or a false lead.
And her blog turned into something more — a way to post messages directly to Michaela in hopes that she is in a position to read them.
“You can write to me, you know,” Murch posted last week. “You can write to me without telling me where you are or who you are with. If you did, I would want to trace your e-mail address and run to where you are, throw my arms around you and take you home with me. But if it would mean the difference between hearing from you and not, I would refrain from doing that.”

TABB Group: US Futures Markets in Crosshairs of Algorithmic

The US futures markets have a target on their backs as newer market stakeholders are taking aim, using algorithms, according to the TABB Group in a new report.
The group further noted that the electronic market makers, hedge funds and long-only asset managers alike are forging algorithmic trading strategies with futures woven into their core. These strategies include a new trading concept, multi-dimensional arbitrage (MDA) that symbolizes this rising cascade of automation, representative of the “next generation” of trading opportunities.
Accordingly, TABB forecasts that total future volumes traded on an automated basis will increase to nearly 60 percent by the end of 2010, up from 43 percent at the end of the third quarter.
To meet accelerating demand, TABB says brokers, exchanges and software vendors need to continue delivery of automated solutions to ensure the long-term growth of the futures markets, which, through new levels of speed, liquidity and strategy, are now on a par with the cash equities markets.
Driving the increased futures volume executed algorithmically, says Paul Rowady, a senior analyst at TABB who wrote “US Futures Markets: In the Crosshairs of the Algorithmic Revolution,” are the growth of high-speed trading, adoption of automation by hedge funds, and traditional managers shifting orders from traditional high- touch to low-touch channels.
Evidence of the speed and depth of the algorithmic revolution can be found in Chicago prop shops and elite East Coast hedge funds where high frequency futures trading is already a mainstay. Additionally, many brokers have extended their execution algo suites and technical infrastructures to the broader hedge fund community.
